These Terms and Conditions govern your use of 2250.care and the services offered through it, including our AI skin scan and personalized skincare recommendations. The service is operated by Singular Skincare Inc., 2093 Philadelphia Pike #9784, Claymont, Delaware 19703, United States. Please read these terms carefully. By using the service, you agree to them.

Acceptance of these terms

These Terms and Conditions (the "Terms") are an agreement between you and Singular Skincare Inc. ("2250", "we", "us", "our"), a company organized under the laws of the State of Delaware with its registered address at 2093 Philadelphia Pike #9784, Claymont, Delaware 19703, United States, which operates 2250.care (the "Service"). They apply to everyone who visits the site, takes a skin scan, or purchases our products.

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, available at 2250.care/pages/privacy. The Privacy Policy explains how we collect and handle your personal data, including your photo and skin analysis results, and forms part of this agreement. Singular Skincare Inc. is the data controller responsible for the personal data processed through the Service. You may exercise your rights of access, rectification, cancellation, and opposition (ARCO rights), and withdraw your consent, through the mechanisms described in the Privacy Policy or by writing to hello@2250.care. If you are in Mexico, you may also file a complaint with the Mexican data protection authority, the Secretaría Anticorrupción y Buen Gobierno, which assumed the data protection functions formerly exercised by INAI.

If you do not agree with these Terms, please do not use the Service. If anything in these Terms is unclear, write to us at hello@2250.care and we will help.

The service

2250 helps you understand your skin and gives you a routine designed around it. You upload a photo of your face, answer a short quiz about your skin type, concerns, and routine, and our system analyzes visible skin characteristics such as hydration, texture, and redness. Based on that analysis, we recommend a personalized routine built from our base formula and targeted active pods.

The skin scan is a cosmetic analysis. It measures the visible condition of your skin for the sole purpose of recommending cosmetic products. It does not identify you against any database and it is not a medical device. A narrow same-person comparison may be used between your own consecutive scans to keep your results consistent, as described in the Privacy Policy. It does not diagnose, treat, cure, or prevent any disease or medical condition.

Our recommendations are not medical advice. If you have a skin condition, an ongoing irritation, or any concern that may be medical in nature, consult a dermatologist or physician. Nothing in the Service replaces professional medical care.

The analysis and the recommendations it produces are informational estimates generated by automated systems. Their quality depends on your photo, your lighting, and the accuracy of your quiz answers, and cosmetic assessment is inherently variable. To the extent permitted by law, we do not warrant that the analysis or any recommendation is accurate, complete, or suited to your skin, and you agree to treat them as a cosmetic guide, not a definitive assessment.

Photo analysis is performed with the support of specialized third-party technology providers acting on our behalf. How your photo and results are processed and stored is described in our Privacy Policy.

Eligibility

The Service is intended for adults. You must be at least 18 years old to use the skin scan or make a purchase on your own. If you are under 18, you may use the Service only with the consent and under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not directed to children under 13, and children under 13 may not use the skin scan or submit photos under any circumstances.

When you use the Service, you confirm that the information you provide is accurate and current, and that any photo you submit is of your own face or that you have clear permission from the person in it.

Products, patch testing and assumption of risk

Our products are cosmetics for external use only. They are not medications and are not intended to diagnose, treat, cure, or prevent any medical condition.

Before using any new product, perform a patch test: apply a small amount to the inside of your forearm and wait 24 hours before applying the product to your face. You agree that performing this patch test before first use is your responsibility.

The complete ingredient (INCI) list for every formula and pod is available on the packaging and on the product page. You are responsible for reviewing it before use and for not using any product that contains an ingredient you know or suspect you are allergic or sensitive to. If you have known allergies or reactive skin, review the list with your dermatologist before use.

If you notice redness, itching, burning, breakouts, or any other irritation at any point, discontinue use immediately and consult a healthcare professional. Continuing to use a product after signs of irritation is at your own risk.

Cosmetics interact with each person's skin differently. By using our products you accept this inherent variability and the ordinary risks of cosmetic use, including the possibility of an individual sensitivity that no screening can fully rule out. Results vary from person to person, and we cannot guarantee specific results. Nothing in this section limits the rights that mandatory consumer protection law gives you, including your rights in the case of defective products, or your refund rights under these Terms.

Purchases, pricing and payment

Purchases on 2250.care are processed through Shopify checkout. Shopify handles your payment information under its own security standards; we do not store your full card details. By placing an order, you confirm that you have the legal right to use the payment method provided and that your billing information is accurate and complete.

In Mexico, prices are shown in Mexican pesos (MXN) and include applicable taxes unless stated otherwise. Prices, products, and availability may change at any time before you complete a purchase.

We may refuse or cancel an order where a product is unavailable, where there is a manifest error in the price or description, or where we suspect fraud or an unauthorized transaction. If we cancel an order you have already paid for, we will refund you in full.

Retail redemption at Farmacias San Pablo

Your personalized recommendation can be redeemed at participating Farmacias San Pablo locations in Mexico. Product availability may vary by store, and in-store availability of specific pods or formulas is not guaranteed.

When you redeem a recommendation in store, the purchase transaction is completed with the retailer, and the retailer's own store policies apply to that transaction alongside these Terms. To prepare and deliver your personalized routine, we share the order information needed for fulfillment with the retailer, as described in our Privacy Policy.

Promotions, pricing, and stock at Farmacias San Pablo are set by the retailer and may differ from 2250.care.

Returns, exchanges and reformulation

We issue refunds for purchases made on 2250.care when requested within fifteen (15) days of the original purchase. To start a return or refund request, write to hello@2250.care with your order number. This fifteen-day policy applies to change-of-mind returns; it does not limit any legal warranty or defect rights you have under applicable law, including under the Ley Federal de Protección al Consumidor in Mexico.

Because your routine is personalized, we also offer reformulation as an alternative. If your recommended routine is not working for your skin, contact us and we will review your scan results and adjust your formula or pods where appropriate. Requesting a reformulation does not waive or reduce your right to a refund within the period described above.

For products redeemed or purchased at Farmacias San Pablo, the retailer's return and exchange policy applies to the in-store transaction. We will still help you with reformulation questions directly at hello@2250.care.

For hygiene and safety reasons, we may decline returns of products that have been substantially used, unless the return relates to a defect or an adverse reaction.

Your content and conduct

You keep ownership of the content you provide, including your photo and your quiz answers. By submitting them, you grant us a limited license to process that content to run your skin analysis, generate your recommendation and results, and provide customer support, as described in our Privacy Policy. We do not use your face photo for advertising without your separate consent.

You agree to use the Service only for lawful purposes. You will not impersonate any person or entity, submit photos of others without permission, or provide false information.

You will not interfere with the Service or attempt to gain unauthorized access to it. This includes introducing malicious code, scraping or copying material through automated means, overloading our infrastructure, or attempting denial-of-service attacks.

We may suspend or terminate your access to the Service, without prior notice, if you breach these Terms. Suspension or termination does not affect orders you have already paid for; we will fulfill them or refund you in full. Provisions that by their nature should survive termination will survive, as described under General provisions.

Intellectual property

The Service and its original content, features, and functionality, excluding content you provide, are and will remain the exclusive property of Singular Skincare Inc. and its licensors. This includes our formulations, recommendation system, designs, text, and imagery, which are protected by copyright, trademark, and other laws of the United States and other countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You may not distribute, modify, reuse, or copy content from the Service for commercial purposes without our express written permission.

If you believe content on the Service infringes your copyright, submit a claim by email to contact@2250.care with the subject line "Copyright Infringement". Include a description of the copyrighted work, the location of the allegedly infringing material, your contact details, a good faith statement that the use is unauthorized, and a statement under penalty of perjury that your notice is accurate and that you are the copyright owner or authorized to act on their behalf, consistent with the Digital Millennium Copyright Act (17 U.S.C. 512(c)(3)).

If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, free-of-charge right to use them in any manner, without any obligation of confidentiality or compensation.

Third-party services and links

We work with specialized service providers to operate the Service, including Shopify for our store, checkout, payments, and hosting, providers of the technology behind the skin analysis, Cloudinary for image processing, and the analytics, email, and review providers listed in our Privacy Policy. These providers process data on our behalf under our instructions.

The Service may also contain links to third-party websites or services that we do not own or control, and those third parties have their own terms and privacy policies. We are not responsible for the content, policies, or practices of third-party websites, and we recommend you read their terms and privacy policies before using them.

To the extent permitted by law, Singular Skincare Inc. is not liable for any damage or loss caused by or in connection with your use of, or reliance on, content, goods, or services available through third-party websites or services.

Disclaimers and limitation of liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Singular Skincare Inc. makes no representations or warranties of any kind, express or implied, statutory or otherwise, about the operation of the Service or the information, content, or materials included in it, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be accurate, reliable, error-free, or uninterrupted, or that defects will be corrected. The skin analysis and the recommendations are informational estimates and are provided without any warranty of accuracy or completeness. This does not affect any warranties that cannot be excluded or limited under applicable law.

To the fullest extent permitted by applicable law, Singular Skincare Inc. and its officers, directors, employees, and agents will not be liable for any indirect, punitive, special, incidental, or consequential damages, however they arise, whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with these Terms, even if we have been advised of the possibility of such damages. Except as prohibited by law, if liability is found on the part of Singular Skincare Inc., it will be limited to the amount you paid for the products and services concerned. Some states and jurisdictions do not allow the exclusion or limitation of punitive, incidental, or consequential damages, so the above limitation or exclusion may not apply to you. Nothing in this section limits or excludes liability that cannot be limited or excluded under applicable law, including liability arising under mandatory consumer protection rules.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Singular Skincare Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your breach of these Terms, your misuse of the Service, your violation of any law, or your violation of the rights of a third party.

This obligation does not apply to the extent a claim arises from our own breach of these Terms or from conduct for which liability cannot be excluded under applicable law, and it does not limit any rights you hold under mandatory consumer protection law.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Nothing in these Terms limits any rights you hold under mandatory consumer protection law in your country of residence, including in Mexico. If you are a consumer in Mexico, you retain all rights granted by the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor), you may file complaints with the Federal Consumer Protection Agency (PROFECO), and nothing in these Terms requires you to bring claims outside the forums made available to you by mandatory law.

Dispute resolution for users in the United States

This section applies only if you reside in the United States. It does not apply to consumers in Mexico. If you are a consumer in Mexico, nothing in this section or in these Terms waives your rights under the Ley Federal de Protección al Consumidor, and you keep full access to PROFECO and to the courts and forums that mandatory Mexican law makes available to you.

If you reside in the United States, you and Singular Skincare Inc. agree that any dispute or claim arising out of or relating to these Terms or the Service, whether based in contract, tort, statute, or any other theory, will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, instead of in court. This section is governed by the Federal Arbitration Act. The arbitrator's award is final and may be enforced in any court of competent jurisdiction, and arbitration fees are allocated under the AAA rules.

Either of us may instead bring an individual claim in small claims court if it qualifies there, and either of us may ask a court for emergency equitable relief to protect intellectual property while an arbitration proceeds.

You and 2250 each waive the right to a jury trial and the right to participate in a class action, consolidated proceeding, or representative action. Claims may be brought only in an individual capacity. If a court finds this class action waiver unenforceable for a particular claim, that claim, and only that claim, must proceed in court, and the waiver remains in effect for all other claims.

You can reject this arbitration agreement without penalty. Within 30 days of first accepting these Terms, email hello@2250.care or write to Singular Skincare Inc., 2093 Philadelphia Pike #9784, Claymont, Delaware 19703, United States, with your name and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

General provisions

Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, epidemics, government actions, labor disputes, supply chain interruptions, and failures of internet or hosting infrastructure. Our obligations are suspended while the event lasts. If such an event prevents us from delivering a paid order for more than thirty days, you may cancel the order and receive a full refund.

Assignment. We may assign these Terms, in whole or in part, in connection with a merger, acquisition, sale of assets, or corporate reorganization; if we do, your rights under these Terms are preserved. You may not assign or transfer these Terms or your rights under them without our prior written consent, and any attempted assignment without that consent has no effect.

Severability and no waiver. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of it; a waiver is effective only if we grant it in writing.

Survival. Provisions that by their nature should survive the end of these Terms will survive, including intellectual property, the licenses you grant us, warranty disclaimers, limitations of liability, indemnification, the dispute resolution section for users in the United States, and this section.

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or communications about it.

Notices. We may send you notices by email to the address you provided or by posting them on the Service. You may send us notices by email to hello@2250.care or by mail to Singular Skincare Inc., 2093 Philadelphia Pike #9784, Claymont, Delaware 19703, United States. A notice sent by email is considered received when it is sent, unless the sender receives an automated message indicating it was not delivered; a notice posted on the Service is considered received when it is posted; and a mailed notice is considered received when it is delivered.

Time to bring claims. To the extent permitted by applicable law, if you reside in the United States, any claim arising out of these Terms or the Service must be filed within one (1) year after it accrues; otherwise it is permanently barred. This paragraph does not apply where the law does not allow the limitations period to be shortened, and it does not apply to consumers in Mexico.

Changes to these terms

We may update these Terms from time to time by posting the revised version on this page and updating the date above. Minor changes are effective when posted. Material changes will be announced with reasonable advance notice, will be highlighted where reasonably possible, and will take effect only after that notice period.

Your continued use of the Service after revised Terms take effect means you accept the changes. If you do not agree to the updated Terms, stop using the Service and contact us if you need help with an existing order.
